Gina Rinehart's daughter, Hope, has formally pulled out of the
bitter, ongoing court battle against her mother over a $4 billion family
trust, after reaching an out-of-court settlement.
The lawyer
for Hope Rinehart Welker told the NSW Supreme Court on Tuesday that she
wished to "withdraw from the proceedings", leaving her siblings John
Hancock and Bianca Rinehart to continue the fight against Australia's
richest person.
In a strange twist, Ms Welker's acceptance of a
share of the family trust - reportedly in excess of $400,000 - as part
of the settlement effectively pits her against her half-brother and
sister in the ongoing civil case.
By accepting a share of the
disputed trust she automatically joins her mother as a defendant in the
case, while Mr Hancock and Bianca Rinehart remain plaintiffs.This model

The
court also heard on Tuesday that while Ms Welker is not expected to
take an active role in the case, if she were called to give evidence in
the case, it would not be favourable to her former allies.
"There
is in the material a statement by the first plaintiff [Ms Welker] that
any evidence she would give would be unhelpful to the second and third
plaintiff [Mr Hancock and Bianca Rinehart]," Gina Rinehart's barrister,

In
September 2011, the siblings launched legal action to remove Rinehart
as the trustee of the $4 billion trust, alleging that she had engaged in
"deceptive, manipulative and disgraceful conduct".
The trust
was set up by their grandfather, Lang Hancock, and controls 23.4 per
cent of Ms Rinehart's flagship company, Hancock Prospecting.
Ms
Welker's split from her American husband, Ryan Welker, last year is
believed to have been the catalyst for the settlement negotiations with
Gina Rinehart last Christmas.
