On Nov. 8, Sondra Aden -- who lived directly next door to Buttercase at 1007 N. 10th St. -- provided sworn testimony to the Gage County District Court judge that she did not see the victim injured in any way the morning of July 16.
According to Aden’s affidavit, she saw Buttercase and the female leave the house at approximately 9 a.m. as she opened blinds to a picture window on the front of her house.
“Immediately upon opening the blinds, I observed a female that I had seen before over at Joseph J. Both Buttercase and the woman left in separate vehicles at that time.
Aden said she recalled the specific day because Beatrice Police began investigating Buttercase's home later that day.
The neighbor said she told Buttercase’s parents the information when they were moving some things from his residence.
No date for hearing has been set.
Buttercase remains lodged in the Gage County Detention Center on a $100,000 bond. His sentencing has been delayed to allow a companion criminal case involving child pornography to conclude.
During the four-day trial, more than 100 exhibits were offered into evidence including blood and semen samples, with the victim and Buttercase each taking the stand to share what happened in the early morning hours of July 16.
The victim said Buttercase raped her, beat her and held her against her will in his home after seeing Buttercase at a downtown Beatrice bar earlier in the evening. Buttercase denied the accusations, telling the court the victim contacted him and willingly came into his home to have consensual sex early that morning.
A doctor told the court the injuries sustained by the victim were consistent with a sexual assault, while a DNA expert said the evidence indicated that Buttercase and the victim were present in the home, not that a rape occurred.
